The Labour Department^ for whom Mr. R. T. Bailey appeared, proceeded against several Chinese fruiterers, all of whom were represented by Mr. 0. A. L. Treadwell, oh charges of failing to close their shops at the specified time. The defendants, who disputed the Department's interpretation of the Act, were Wong Tong and Co. Cuba street, Ngan Tong and Sons, Oweii street, and -Shim Hoo Ching, Aro street. Mr. Bailey urged that once a fruiterer sold anything but the usual stock of a fruiterer he placed himself outside the law unless he closed his shop at the hour specified in the Act. The opposite view was adopted by Mr. Treadwell, who submitted that no offence had been disclosed in view of the conditions of. the Act.
